We'll break down the key scheduling laws in a clear and concise way, providing you with the information and tips you need to keep your dispensary running smoothly and your employees happy.

An Overview of Key California Scheduling Laws 

Several California labor laws, directly and indirectly, affect how you schedule your dispensary staff. This section breaks down the essentials of California labor code to help you create clear and compliant schedules for your dispensary team. 

Reporting Time Pay

California Labor Code Section 203 requires you to compensate employees for showing up for scheduled shifts where they’re sent home early, or their shift is canceled. This law encourages proper scheduling and protects your employees' time.

As a dispensary owner, you should be aware of several key points when it comes to reporting time pay: 

  • When do I have to pay reporting time pay? You must pay reporting time pay when an employee reports for a scheduled shift, but you either cancel the shift entirely or send them home early with less than half of their scheduled hours remaining.

  • How much reporting time pay is owed to an employee? You must pay the employee for half of their scheduled shift pay, with a minimum of two hours and a maximum of four hours, all at their regular rate.

  • If an employee works for less than two hours, do I still need to pay them reporting time pay? Yes, even if an employee works for less than two hours after reporting, you must still pay the minimum two hours of reporting time pay.

Predictive Scheduling

While California doesn’t have a statewide predictive scheduling law, several major cities have regulations specifically impacting dispensary scheduling. Here’s a breakdown of what to expect in cities like Berkeley, Emeryville, Los Angeles, and San Francisco: 

  • Two-Week Advance Schedule: You're required to provide employees with their work schedule at least two weeks in advance.

  • Good-Faith Estimate for New Hires: New employees deserve to know their expected workload. Provide a good-faith estimate of their schedule before their first shift.

  • The Right to Request Changes: Employees have the right to request changes to their initial schedule, and you're obligated to consider them.

  • Written Notice for Scheduling Changes: Any adjustments made to the schedule after initial posting require written notification to the employee.

  • The Right to Decline: Employees have the "Right to Decline" last-minute changes. If they accept, they may be entitled to predictability pay.

  • The Right to Rest: Respect your employees' well-being. They can decline shifts scheduled too close to their previous shift and may be entitled to additional compensation if they accept.

  • The Right to Request Flexibility: Employees can request flexible work schedules without fear of retaliation.

Meal and Rest Breaks

  • Meal Breaks vs. Rest Breaks: Meal breaks are unpaid breaks of at least 30 minutes that are provided for shifts exceeding five hours. Rest breaks are paid, 10-minute breaks that are provided for every four hours worked (or major portion thereof). 
  • Break Frequency: Meal breaks should be scheduled to prevent employees from working more than five hours without one. Rest breaks should be uninterrupted and provided near the middle of the shift whenever possible.

  • Second Meal Break: Shifts exceeding 10 hours require a second meal break before the end of the tenth hour.

  • Break Waivers: Meal and rest breaks can be waived with mutual consent of both the employer and the employee, but they must still be offered. The only exception is when an employee is working a shift that’s between 10-12 hours and they did not take their first meal break.

  • Consequences of Non-Compliance: Failure to provide a required break incurs a penalty of one additional hour's pay at the employee's regular rate.
